Terms of Service

Welcome to Sanamen. These Terms of Service ("Terms") govern your access and use of our mental health, nutrition and wellness platform. By registering or using Sanamen, you agree to be bound by these Terms.

Important Notice

Sanamen is not an emergency service. If you are experiencing a mental health crisis or suicidal thoughts, please contact immediately:

1. Acceptance of Terms

By accessing or using Sanamen (the "Service"), you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Sanamen S.L. ("we", "our" or "the Company") is the operator of the platform.

2. Eligibility and Registration

2.1. Age Requirements

  • You must be at least 14 years old to use Sanamen.
  • If you are between 14 and 18 years old, you need parental or legal guardian consent.
  • Users under 18 must provide legal guardian contact information.

2.2. Registration Information

When registering, you warrant that:

  • All information you provide is true, accurate and up to date.
  • You will maintain the security of your password and not share it.
  • You are responsible for all activities that occur under your account.
  • You will immediately notify us of any unauthorized use of your account.

3. Professional Services

3.1. Nature of Service

Sanamen is a platform connecting users with verified professionals:

  • Psychologists: Psychological therapy and counseling
  • Nutritionists: Meal plans and nutritional counseling
  • Personal trainers: Exercise routines and physical wellness

3.2. Professional Verification

We verify professional credentials (degrees, licensing, experience) of all specialists before approving their profiles. However, you are responsible for evaluating whether a specific professional is suitable for your needs.

3.3. Professional-Client Relationship

Important: Sanamen is solely a connection platform. The therapeutic or professional relationship is between you and the specialist, not with Sanamen.

  • Professionals are independent contractors, not Sanamen employees.
  • Professionals are responsible for the quality and legality of their services.
  • Sanamen does not practice medicine, psychology or nutrition.
  • Treatment decisions are between you and your professional.

⚠️ Service Limitations

  • Sanamen does NOT provide medical diagnoses.
  • Sanamen does NOT prescribe medications.
  • Sanamen does NOT substitute emergency care.
  • Sanamen does NOT guarantee specific treatment outcomes.

4. Payments and Billing

4.1. Service Fees

  • Prices are shown in EUR (€) and include 21% VAT.
  • Professionals set their own rates.
  • Sanamen charges a commission on booked sessions.
  • Prices may change with 30 days prior notice.

4.2. Payment Methods

We accept:

  • Credit/debit cards (Visa, Mastercard)
  • SEPA Direct Debit
  • Secure processing through Stripe (GDPR compliant)

4.3. Refund Policy

User Cancellation:

  • More than 24 hours before: Full refund (100%)
  • Between 12-24 hours before: 50% refund
  • Less than 12 hours: No refund (0%)

Professional Cancellation:

  • Full refund in all cases.
  • Additional 10% credit for your next session.

Processing: Refunds are processed in 5-7 business days and appear in the original payment method.

4.4. Invoicing

You will receive an invoice in accordance with Spanish regulations with VAT (21%) for each transaction. Invoices are available in your billing dashboard.

5. Appointments and Video Sessions

5.1. Appointment Booking

  • Appointments must be booked at least 2 hours in advance.
  • Confirmation via email and platform notification.
  • It is your responsibility to be available at the agreed time.

5.2. Video Call Sessions

  • We use Daily.co for secure video calls (EU servers).
  • You need a stable internet connection and a device with camera/microphone.
  • Sessions are NOT automatically recorded (requires explicit consent).
  • If you are more than 15 minutes late, the professional may cancel the session without refund.

5.3. Technical Requirements

  • Updated browser (Chrome, Firefox, Safari, Edge)
  • Internet connection of at least 3 Mbps
  • Camera and microphone permissions enabled

6. User Conduct

You agree NOT to:

  • Use the Service for illegal or unauthorized purposes.
  • Harass, abuse or threaten professionals or Sanamen staff.
  • Provide false or misleading information.
  • Attempt to access other users' accounts.
  • Distribute viruses, malware or harmful code.
  • Reverse engineer or decompile the platform.
  • Collect data from other users without consent.
  • Use bots, scrapers or automated tools.

Consequences of Violation

We reserve the right to suspend or terminate your account immediately without prior notice if you violate these Terms. In serious cases, we may inform the relevant authorities.

7. Intellectual Property

7.1. Sanamen Content

All platform content (design, texts, graphics, logos, code) is owned by Sanamen S.L. or its licensors and is protected by Spanish and international intellectual property laws.

7.2. User Content

You retain ownership of all content you post (messages, comments, photos). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display that content in connection with the operation of the Service.

8. Limitation of Liability

8.1. "AS IS" Services

Sanamen provides the platform "as is" and "as available". We do not guarantee that the Service will be uninterrupted, secure or error-free.

8.2. Medical Disclaimer

Sanamen is NOT responsible for:

  • The quality or results of services provided by professionals.
  • Diagnoses, treatments or advice given by professionals.
  • Professional negligence or malpractice.
  • Medical decisions made based on platform information.

8.3. Damage Limits

To the maximum extent permitted by law, our total liability to you for any claim will not exceed the amount you have paid to Sanamen in the 12 months prior to the claim.

9. Termination

9.1. By User

You can cancel your account at any time from Settings → Privacy. A 30-day grace period will apply during which you can cancel the deletion. See our Privacy Policy for more details on data deletion.

9.2. By Sanamen

We may suspend or terminate your account immediately if:

  • You violate these Terms.
  • You do not pay outstanding fees.
  • Your account remains inactive for more than 2 years.
  • Required by law or court order.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any dispute related to these Terms will be resolved in the courts of Madrid, Spain.

If you are a consumer resident in the EU, you also have the right to use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr

11. Changes to Terms

We may modify these Terms occasionally. We will notify you of material changes at least 30 days in advance by email or through a prominent notice on the platform.

Your continued use of the Service after changes constitutes your acceptance of the new Terms. If you do not agree, you must stop using the Service and cancel your account.
